Our friends at United Public Workers scored a victory in arbitration against Honolulu City & County for temporary hazard pay. The arbitrator in their case awarded 15% for each hour worked during the 24-month period of the pandemic for all UPW classes (regardless of whether they filled out an individual THP request form), with uku pau workers receiving full compensation. The decision marks the biggest victory for their union.
But there are also big implications in their case for us.
Judge Simeon Acoba rejected the city’s attempts to treat THP individually, on an employee-by-employee basis. And that’s exactly what the city has been trying to do with us.
The arbitrator also rejected arguments by the city that employees must prove how and when they were exposed. He ruled that the virus’ presence in the workplace is a reasonable expectation given the conditions of the pandemic. This, too, helps our case.
Let’s be clear: this UPW ruling changes the whole landscape of our discussions with the city. We’re prepared to use this as precedence to bolster our already persuasive case.
Rest assured we’re in a stronger position today because of this ruling. We’ll update you as we continue to press the city for resolution.
