CITY & COUNTY THP SETTLEMENT FOR “NON-FILERS”

You have until June 26, 2025 to file an appeal if you disagree with your designation as a “non-filer” and believe you filed a timely temporary hazard pay claim or were told or directed not to file one.
Details of the appeals process come on the heels of ratification of the city’s settlement offer. The city offered $7,500 to you and other employees in Units 2, 3, 4 and 13 who worked for the city during the period from March 5, 2020 to March 5, 2022 and did not file requests for THP as was required under the initial 2021 settlement agreement.
If you disagree with your status and plan to appeal, you should use the city’s provided form and include evidence in support of your position. A mutually agreed upon third party will issue a final and binding decision on the appeal. The form will be provided by the employer.
If you are disputing the city’s position and believe you should be entitled to the $15,000 offer for those who filed a timely THP claim, you should do the following:

Note the following from the city’s settlement offer dated May 5, 2025:
In requesting such review by the third-party decision-maker, written evidence of a request for THP contemporaneously with the claim deadline established in the 2021 settlement agreement, must include evidence that can be substantiated by at least one person other than the employee who is making the request, i.e., the employee’s supervisor, division chief, department personnel officer, department administrative services officer, or department director, or, receipt acknowledgement by the Director of the Department of Human Resources (DHR) or the Industrial Safety and Workers’ Compensation Division of DHR.The request form and evidence must be submitted via email to wilbertholck22@gmail.com with cc: to DHRTHP@honolulu.gov and citythp@hgea.org.
